Duo Pack
- The Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”). The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as any applicable terms and conditions, including the standard terms and conditions of each individual service making up The Bundle. In the event of any difference or conflict between The Bundle Service Terms and Conditions and any applicable terms and conditions, including the standard terms and conditions of each individual service making up The Bundle, The Bundle Service Terms and Conditions shall prevail.
- The Bundle entitles You to all of the following services:
- GO Talk Anytime fixed phone line service.
- Up to 4Mbps GO fixed Internet service subject to the speed your line can attain.
- If You are a new GO fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in clause 2(a) above. For the avoidance of doubt, the free fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.
- If You are an existing GO fixed phone line customer and at time of subscription to The Bundle, You require a transfer of Your current fixed phone line, The Bundle entitles You to free one-time transfer charges. For the avoidance of doubt, the fixed phone line must be transferred to the Residential Premises indicated in The Agreement.
- If You are a new GO fixed internet customer, The Bundle entitles You to free use of modem. GO fixed internet service is provided on a self-install basis. Should You request a GO installation the applicable fees as stipulated in the Schedule of Charges will apply. Should any other equipment be required, the cost of any such additions shall be borne by You.
- The Bundle as described in clause 2 will be charged at the rate of nineteen euro and ninety-nine euro cents (€19.99) per month and shall come into force from the date when the last of the services specified in clause 2(a), 2(b) above would have been activated at the Registered Premises as indicated in The Agreement. For the avoidance of doubt, any applicable usage charge shall commence from the date of the activation of the particular service.
- By entering into The Agreement for the provision of The Bundle, You are hereby irrevocably:
- Committing to a minimum term of twenty-four (24) consecutive months (hereinafter referred to as “Term”) from the date (hereinafter referred to as “Commencement Date”) of the last of the following services to be activated (i) GO Talk Anytime fixed phone line service (ii) GO fixed internet service subscription of up to 4Mbps or above.
- Committing to installing both the (i) GO Talk Anytime fixed phone line service, (ii) GO internet service subscription of up to 4Mbps or above, at Residential (non-commercial) Premises owned by Yourself as indicated in The Agreement within thirty (30) days from date of request of The Bundle.
- You also agree and consent that Your personal data, traffic data and communications data relating to Your use of the Service will be retained and processed in line with the applicable data protection and retention legislation and that We may disclose any of this:
(i) among the group companies forming part of the GO group;
(ii) Our sub-contractors or agents;
(iii) between Us and other third parties including other authorised electronic communications providers and operators, Content providers, market research operators, and credit agencies. You acknowledge that such sharing of data is necessary for the purpose of providing better value and services in particular on the electronic communications services or other services as might be provided by Us as well as for fraud prevention, debts and credit referencing and to protect Our legitimate interests, those of Our parent company, Our subsidiaries and other electronic communications operators and third parties. We commit to preserve all Your rights as data subject at all times;
(iv) if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of the Agreement, respond to claims that any use of the Services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of the GO group, its directors, employees, users and the general public.
- You acknowledge and agree that the modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the modem shall be returned to Us upon termination of The Bundle . In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, wilful damage by liquids, connection to unsuitable supply power, surges, lightning, tampering or service by unauthorised personnel, You will be liable to pay to Us the sum of fifty euro (€50.00). Such charge shall be paid directly to Us.
- You warrant and bind Yourself to pay, a one-time charge of seventy-five euro (€75.00) should You terminate The Bundle and/or any of the services as described in clause 2 (a) and (b) prior to the lapse of the twenty-four (24) month minimum term.
- After expiry of the Term, You will automatically be renewed onto a new twenty-four (24) month term of The Bundle. Should You not wish to renew The Bundle, You must notify Us in writing thirty (30) days prior to the expiry of the Term.
- For the avoidance of doubt, in the event that You terminate or do not renew The Bundle as per clause 10 and clause 11 respectively but choose to retain any of the services offered by Us, You agree that the retained services shall be charged at the standard rates applicable at the time and will be governed by the applicable terms and conditions.
- The Bundle is applicable only where the fixed phone line service and fixed internet service can be reached by the GO network. Should one of the services not be available, We will inform You in writing of the options available to You and the respective charges that would be applicable. Unless You inform us in writing of Your intention not to remain subscribed to the service that can be provided within five (5) days of Our notification in terms of Clause 13, it shall be deemed that You consent to remain subscribed to the individual service concerned in accordance to the applicable terms and conditions and agree to pay the relative charges connected therewith.
- Once all Bundle services as indicated in clause 2 have been activated, The Agreement, of which The Bundle Service Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or GO fixed internet services.
- All charges related to the service including Equipment charges will be billed according to the billing period depending on your Agreement with Us. Go reserves the right to charge a fee for invoices sent by post should an e-billing service be made available.
16. We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.
- We reserve the right to terminate The Agreement in the event of non-payment, any deliberate abuse and/or misuse of the services subject matter of The Agreement, or any other breach of the applicable terms and conditions or of law.
- We reserve the right to amend these Bundle service terms and conditions at any time, provided that We shall give You a thirty (30) days’ written notice prior to such amendments taking effect. Should You not wish to accept the proposed amendments, You must, within thirty (30) days of having been so notified, inform Us of such non-acceptance. For the sake of clarity, such notification of non-acceptance on Your part shall be deemed to constitute a termination of The Agreement in terms of clause of 10 above in which event, the penalty charges therein stipulated shall not become applicable. Failure on the part of Yourself to notify Us in writing within the stipulated time period of such non-acceptance will constitute an irrevocable acceptance of any such amendments for the duration of The Agreement
- These Bundle service terms and conditions and all matters relating to it shall be governed, construed and take effect in accordance with the laws of Malta and the parties hereby submit to the exclusive jurisdiction of the Courts in Malta.
- These Bundle service terms and conditions have been drafted in the English language and the English text shall be regarded as the authoritative text. If these Bundle terms and conditions are translated into any other language, any ambiguity or disagreement that may arise shall be resolved by reference to the English text.
Home Pack 33
- This Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”). The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as the standard terms and conditions of each individual service making up The Bundle and any other applicable terms and conditions. In the event of any difference or conflict between The Bundle Service Terms and Conditions, the standard terms and conditions of each individual service making up The Bundle, and any other applicable terms and conditions, The Bundle Service Terms and Conditions shall prevail.
- The Bundle entitles You to all of the following services at the rate of thirty-three euro (€33) per month:
- GO Silver television service.
- GO Talk Anytime fixed phone line service.
- Up to 4Mbps GO internet service, subject to the speed your line can attain.
- Up to 400 free mobile minutes on a monthly basis, given in up to four (4) individual free minute bundles of 100 minutes each, with one (1) bundle per individual member within the Home Pack mobile community (‘’Community”) in accordance with clause 8 below.
- The rate of thirty-three euro (€33) per month includes the GO Network Access fee of one (1) set-top box/CAM. To activate GO Silver television service on other set-top boxes/CAMs within the Residential Premises, an additional monthly GO TV Network Access fee per set-top box /CAM as per Schedule of Charges applies.
- If You are a new television customer, The Bundle entitles You to all of the following:
- Free installation of the GO television service indicated in clause 2(a) above on up to two (2) set-top boxes/ CAMs, including antenna if required. For the avoidance of doubt, the free GO television installation will be provided at the Residential Premises indicated in The Agreement.
b. Up to a maximum of two (2) free set-top boxes/CAMs, in accordance with clause 5 below.
- If You are an existing GO television subscriber, and have already benefitted from a set-top box/CAM offer under a previous offer, You would be entitled to the free use of an additional set-top box/CAM when upgrading to The Bundle, and committing to all terms and conditions of The Bundle and provided that the total number of set- top boxes/CAMs provided for Your use as part of The Bundle or any other prior offer is not more than two (2) and subject that you commit for a further 24 consecutive month period. For the avoidance of doubt, it is being agreed that the set-top boxes/CAMs are being leased free of charge, and any equipment will remain property of GO.
- If You are a new fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in clause 2(b) above. For the avoidance of doubt, the free GO fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.
- If You are a new GO internet customer, The Bundle entitles You to the free use of a GO standard modem for the internet service indicated in clause 2(c) above. For the avoidance of doubt, it is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.
- For You to benefit from the free bundle of mobile minutes as per clause 2(d) above, You need to activate Your Community as per clause 11 below. You may also invite up to three (3) other GO mobile numbers, in addition to Your GO mobile number to form part of the Community. The four (4) Community members can be either subscribed to any Pay As You GO mobile tariff plan as per clause 9 below or to any of the GO mobile Pay Monthly Plans compatible with Home Pack. The latter will hereinafter be referred to as “Pay Monthly”. For the avoidance of any doubt, every member of the Community is entitled to a maximum of one hundred (100) free minutes per month and no transfer of minutes from one member to another is allowed.
- If You are a Pay As You GO mobile customer, Your tariff plan will change to the Pay As You GO Home Pack mobile tariff plan once Your request to activate the Community is successful. If any of the other GO mobile numbers You decide to add to Your Community further to clause 8 above, are also Pay As You GO mobile customers, their tariff plan will also change to the Pay As You GO Home Pack mobile tariff plan once they accept to join Your Community.
- A Community is a group of up to four (4) Pay As You GO and/or Pay Monthly GO mobile customers as per clauses 8 and 9 above, who can benefit from free mobile minutes by joining a Community. The GO mobile number nominated by Yourself to activate the Community will be able to invite three (3) other eligible GO mobile customers as indicated in clause 8 above, to form part of the Community. The first three Community members are added free of charge. Any changes thereafter cost €1.16 per number. Without prejudice to Your and/or Our right to suspend and/or terminate this Agreement, for the avoidance of doubt, it is hereby being expressly stated and agreed that only the registered GO mobile number nominated by Yourself to activate the Community will have the right for the day to day management of and for any information associated with the Community. To be eligible to join a Community, the GO mobile numbers:
- Must be verified by GO as registered customers on the appropriate tariff packages;
- Can only form part of one (1) Community at any given time.
- The Community is formed as follows:
- The Pay As You GO or Pay Monthly number nominated by Yourself activates the Community by sending an SMS to 50700280, containing The Agreement number and the GO Talk Anytime fixed phone line number forming part of The Bundle. The format of the SMS should be as follows: 2XXXXXXX PXXXXXXXXXX (or 2XXXXXXX 0XXXXXXXXXX), where 2XXXXXXX indicates the GO Talk Anytime fixed phone line number and PXXXXXXXXXX (or 0XXXXXXXXXX) indicates The Agreement number. The SMS is free of charge.
- The Pay As You GO or Pay Monthly number nominated by Yourself can invite up to three (3) other Pay As You GO and/or Pay Monthly customers to the Community by sending an SMS to 50700281 containing the mobile number being requested to be added to the Community. Each of these SMS is free of charge. As per clause 10 above any changes to these numbers can be made at the cost of €1.16 per number.
- The Pay As You GO and/or Pay Monthly customers eligible to join the Community will become members of the Community only once they accept Your invitation by replying to the SMS sent from GO, and the Community will be considered to be full once three (3) Pay As You GO and/or Pay Monthly customers together with the Pay As You GO or Pay Monthly number nominated by Yourself have joined the Community.
- Once the Community is set up, The Bundle will entitle You to:
- up to four hundred (400) free mobile minutes given in individual bundles of one hundred (100) minutes each in accordance with clause 2 (d) above and which can be used as follows:
- on calls between the four (4) GO mobile numbers within the same Community in accordance with clause 11 above.
- on calls from the four (4) GO mobile numbers towards the GO Talk Anytime fixed phone line number forming part of The Bundle.
- Your free mobile minute bundle, as per clause 2(d) above will be assigned on the day of successful creation of Your Community. Invited Community members will be assigned their respective free mobile minute bundle upon successful registration to Your Community. In the case of Pay As You GO mobile customers each individual bundle will be assigned in full upon joining the Community and will then be renewed each month, on the same date when the first bundle has been assigned. For customers on Pay Monthly plans, their individual free mobile minute bundle will always be assigned on the 1st of every month except for the first bundle which will be assigned on a pro-rata basis on the date when they have successfully joined the Community
- Any unutilised free minutes are not carried forward if not consumed within the month.
- The free minutes cannot be transferred through Credit Transfer.
- The free -minutes are deducted on a per 30-second basis.
- The maximum call duration is 60 minutes and calls shall be automatically terminated when the 60 minutes have elapsed.
- Upon consumption of each individual free mobile minute bundle, intra-community calls to each individual Community member (including calls towards the GO Talk Anytime fixed phone line number) are to be charged at the applicable rates in accordance with the customers’ Tariff Plan. It is Your responsibility to inform the Community members of these conditions.
- The Pay As You GO or Pay Monthly number nominated by Yourself can send a blank SMS to 50700284 at a charge of €0.05 to query the Community members.
- Members of a Community can check whether a number is part of a Community by sending a SMS quoting the number to be checked to 50700284 at a cost of €0.05.
- Members of a Community can check the remaining balance of minutes in their respective free bundle by sending a blank SMS to 50700285 at a charge of €0.05.
- Calls from the GO Talk Anytime fixed phone line towards the registered applicable Community’s GO mobile numbers will be charged as per the Talk Anytime rates.
- The free minutes assigned to each individual Community member, as per clause 2(d), can be used when making calls from Malta in line with clause 12 (a). For the avoidance of doubt any other calls made whilst in Malta to numbers not members in Your Community will be charged at the local call rates applicable to the customer’s mobile tariff plan. The standard charges apply when calling from abroad. For further information regarding roaming charges, please refer to Roaming section of theGO website.
- A Community member is deemed to be part of the Community until:
- The Community member sends a blank SMS to 50700282 (free of charge) at any time to withdraw from the Community. In cases of Pay As You GO type of subscriptions, any Community members withdrawing from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.
- The Pay As You GO or Pay Monthly number nominated by Yourself excludes a member of the Community by sending a SMS to 50700283 (cost is €0.05) containing the mobile number being requested to be withdrawn from the Community. In cases of Pay As You GO type of subscriptions, any Community members removed from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.
- The Agreement is terminated or not renewed, for any reason and by any Party.
- The free minutes entitlement in line with clause 2(d) above will no longer be available if:
- The Agreement is terminated or not renewed, for any reason and by any Party;
- We suspend and/or disconnect any or all of the Services making up The Bundle for any reason attributable to You;
c. You or the number nominated by Yourself terminates the Community.
d. The Pay As you GO or Pay Monthly number nominated by Yourself is no longer a GO subscriber for mobile services or migrates to any other Tariff Plan not compatible with The Agreement.
- By entering into The Agreement with GO for the provision of The Bundle, You are hereby irrevocably Consent that:
- Your personal data, traffic data and communications data relating to Your use of the Services forming part of The Agreement, including any mobile telephony, will be retained and processed in line with the applicable data protection and retention legislation and that GO may disclose any of this:
(i) among the group companies forming part of the GO group;
(ii) Our sub-contractors or agents;
(iii) between Us and other third parties including other authorised electronic communications providers and operators, Content providers, market research operators, and credit agencies. You acknowledge that such sharing of data is necessary for the purpose of providing better value and services in particular on the electronic communications services or other services as might be provided by Us as well as for fraud prevention, debts and credit referencing and to protect Our legitimate interests and other electronic communications operators and third parties. We commit to preserve all Your rights as data subject at all times;
(iv) if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of The Agreement, respond to claims that any use of the Services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of Us, Our directors, employees, users and the general public.
- Committing to both installing/retaining the (i) GO Talk Anytime fixed phone line service,(ii) GO television service subscription to Silver or above, and (iii) GO internet service subscription up to 4Mbps or above at Residential (non-commercial) Premises owned by Yourself or properly leased in Your name, as indicated in The Agreement within 30 days from date of request of The Bundle.
- Committing to a minimum period of 24 consecutive months (” Term”) from the date of the last of the following services to be installed (i) GO Talk Anytime fixed phone line service (ii) GO television service subscription to Silver or above (iii) GO internet service subscription to 4Mbps or above (“Commencement Date”).
- The Bundle fee of thirty-three euro (€33) per month shall come into force from the date when the last of the services specified in clause 2(a), 2(b) and 2(c) above would have been installed at the Registered Premises as indicated in The Agreement. For the avoidance of doubt, any applicable usage charge shall commence from the date of the installation of the particular service.
- Unless The Agreement is earlier terminated, on the expiry of the Term or any subsequent renewed Term, subject that The Bundle would still be commercially marketed at the time, The Agreement will be automatically renewed for further twenty-four (24) month period. Should You not wish to renew The Bundle, You must notify Us in writing at least fifteen (15) days prior to expiry of the Term or any subsequent renewed Term.
- You acknowledge and agree that any free set-top boxes/CAM / modem You may be entitled to under The Bundle Terms and Conditions will only be issued whilst The Bundle is still being offered to the public. For the avoidance of doubt, You acknowledge and agree that any set-top box/ CAM /modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the set-top box/ CAM / modem shall be returned to Us upon termination, for whatever reason, of this Agreement. In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, willful damage, connection to unsuitable supply power, surges, lightening, tampering or service by unauthorised personnel, You will be liable to pay to Us the sum of seventy-five euro (€75) per leased set-top box/CAM and fifty euro (€50) for the modem. Such charge shall become immediately due and is to be paid directly to Us.
- Should The Bundle and/or any of the services as described in clause 2 (a), (b) and (c) be terminated by either You, or Us for any reason attributable to You, prior to the lapse of the Initial Term, the following penalty charges, which for clarity are in addition to any other fees, dues, or charges howsoever defined in terms of The Agreement, shall become immediately applicable:
a. a one-time Bundle Disconnection fee of fifty euro (€50) and;
b. A one-time charge of sixty-four euro and ninety-nine euro cents (€64.99) for the lease of each set-top box/CAM that has been provided to You by Us.
- For the avoidance of doubt, in the event that You terminate The Bundle as per clause 19 above or opt not to renew The Bundle after the expiry of the Term, but choose to retain any of the services offered by Us, You agree that these services shall be charged at the standard rates applicable at the time and are governed by the applicable terms & conditions.
- The Bundle is applicable only in those geographical areas where the television service, fixed phone line service, and internet service can be covered by Us. Should one of the services not be available, We will inform You in writing of the options available and the respective charges that will come into force within thirty (30) days of having been so notified. For the avoidance of doubt, should You be terminating The Bundle to temporarily/permanently move to any other Residential Premises where the television service, fixed phone line service and internet service cannot be reached by Us, the charges as explained in clause 19 will remain applicable.
- The Bundle is applicable only where Your Residential Premises are reached by full DTTV coverage. At Our discretion, a free booster to improve signal level to Our requirement may be provided at no cost for the duration of The Bundle. Replacements to any damaged booster after date of installation will be provided by Us against the applicable charges as per Schedule of Charges.
23. Once all Bundle services as indicated in clause 2 have been activated, The Agreement, of which The Bundle Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or television and/or internet services.
- For the avoidance of doubt, in the event that You choose to subscribe to any of the Home Pack add-on services which We may issue from time to time, to the extent applicable the respective Home Pack add-on service shall be governed by the applicable standard terms and conditions of the individual service, without, however, in any way diminishing Your obligations in terms of The Agreement.
- We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.
- All charges related to the service including Equipment charges will be billed according to the billing period depending on your Agreement with Us. Go reserves the right to charge a fee for invoices sent by post should an e-billing service be made available.
- We reserve the right to terminate this Agreement in the event of any deliberate abuse and/or misuse of the services subject matter of this Agreement, or if in default of payment.
- We reserve the right to amend these terms and conditions at any time, provided that We shall give You a thirty (30) days’ written notice prior to such amendments taking effect. Should You not wish to accept the proposed amendments, You must, within thirty (30) days of having been so notified, inform Us of such non-acceptance. For the sake of clarity, such notification of non-acceptance on Your part shall be deemed to constitute a termination of The Agreement in terms of clause of 19 above in which event, the penalty charges therein stipulated shall not become applicable. Failure on Your part to notify Us in writing within the stipulated time period of such non-acceptance will constitute an irrevocable acceptance of any such amendments for the duration of this Agreement.
- This Agreement and all matters relating to it shall be governed, construed and take effect in accordance with the laws of Malta and the parties submit to the exclusive jurisdiction of the courts in Malta.
- This Agreement has been drafted and negotiated in the English language and the English text shall be regarded as the authoritative text. If this Agreement is translated into any other language, any ambiguity or disagreement that may arise shall be resolved by reference to the English text.
Home Pack 42
- This Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”). The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as the standard terms and conditions of each individual service making up The Bundle and any other applicable terms and conditions. In the event of any difference or conflict between The Bundle Service Terms and Conditions, the standard terms and conditions of each individual service making up The Bundle, and any other applicable terms and conditions, The Bundle Service Terms and Conditions shall prevail.
- The Bundle entitles You to all of the following services at the rate of forty-two euro (€42) per month:
- GO Gold television service.
- GO Talk Anytime fixed phone line service and 60 free minutes to other local fixed phone line networks in accordance with clause 7 below.
- Up to 4Mbps GO internet service, subject to the speed your line can attain.
- Up to 400 free mobile minutes on a monthly basis, given in up to four (4) individual free minute bundles of 100 minutes each, with one (1) bundle per individual member within the Home Pack mobile community (‘’Community”) in accordance with clause 9 below.
- The rate of forty-two euro (€42) per month includes the GO Network Access fee of one (1) set-top box/CAM. To activate GO Gold television service on other set-top boxes/CAMs within the Residential Premises, an additional monthly GO TV Network Access fee per set-top box /CAM as per Schedule of Charges applies.
- If You are a new television customer, The Bundle entitles You to all of the following:
a. Free installation of the GO television service indicated in clause 2(a) above on up to two (2) set-top boxes/ CAMs, including antenna if required. For the avoidance of doubt, the free GO television installation will be provided at the Residential Premises indicated in The Agreement.
b. Up to a maximum of two (2) free set-top boxes/CAMs, in accordance with clause 5 below.
- If You are an existing GO television subscriber, and have already benefitted from a set-top box/CAM offer under a previous offer, You would be entitled to the free use of an additional set-top box/CAM when upgrading to The Bundle, and committing to all terms and conditions of The Bundle and provided that the total number of set- top boxes/CAMs provided for Your use as part of The Bundle or any other prior offer is not more than two (2) and subject that you commit for a further 24 consecutive month period. For the avoidance of doubt, it is being agreed that the set-top boxes/CAMs are being leased free of charge, and any equipment will remain property of GO.
- If You are a new fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in clause 2(b) above. For the avoidance of doubt, the free GO fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.
- The Talk Anytime service will entitle You to an additional sixty (60) free minutes to other local fixed phone line networks per month for the duration of The Agreement on the following conditions: a. The 60 free minutes are assigned on the first day of each month and are valid within the same month. b. Any unutilised free talk-time is not carried forward if not consumed within the month. c. The free talk-time is deducted on a per minute basis. d. Upon consumption of the 60 free minutes, calls to other local fixed phone line networks are to be charged at the applicable Talk Anytime rates.
You can check the remaining balance of minutes by subscribing to the My GO online service provided by GO. Such service is provided to You free of charge.
- If You are a new GO internet customer, The Bundle entitles You to the free use of a GO standard modem for the internet service indicated in clause 2(c) above. For the avoidance of doubt, it is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.
- For You to benefit from the free bundle of mobile minutes as per clause 2(d) above, You need to activate Your Community as per clause 12 below. You may also invite up to three (3) other GO mobile numbers, in addition to Your GO mobile number to form part of the Community. The four (4) Community members can be either subscribed to any Pay As You GO mobile tariff plan as per clause 10 below or to any of the GO mobile Pay Monthly Plans compatible with Home Pack. The latter will hereinafter be referred to as “Pay Monthly”. For the avoidance of any doubt, every member of the Community is entitled to a maximum of one hundred (100) free minutes per month and no transfer of minutes from one member to another is allowed.
- If You are a Pay As You GO mobile customer, Your tariff plan will change to the Pay As You GO Home Pack mobile tariff plan once Your request to activate the Community is successful. If any of the other GO mobile numbers You decide to add to Your Community further to clause 9 above, are also Pay As You GO mobile customers, their tariff plan will also change to the Pay As You GO Home Pack mobile tariff plan once they accept to join Your Community.
- A Community is a group of up to four (4) Pay As You GO and/or Pay Monthly GO mobile customers as per clauses 9 and 10 above, who can benefit from free mobile minutes by joining a Community. The GO mobile number nominated by Yourself to activate the Community will be able to invite three (3) other eligible GO mobile customers as indicated in clause 9 above, to form part of the Community. The first three Community members are added free of charge. Any changes thereafter cost €1.16 per number. Without prejudice to Your and/or Our right to suspend and/or terminate this Agreement, for the avoidance of doubt, it is hereby being expressly stated and agreed that only the registereGO mobile number nominated by Yourself to activate the Community will have the right for the day to day management of and for any information associated with the Community. To be eligible to join a Community, the GO mobile numbers:
- Must be verified by GO as registered customers on the appropriate tariff packages;
- Can only form part of one (1) Community at any given time.
- The Community is formed as follows:
- The Pay As You GO or Pay Monthly number nominated by Yourself activates the Community by sending an SMS to 50700280, containing The Agreement number and the GO Talk Anytime fixed phone line number forming part of The Bundle. The format of the SMS should be as follows: 2XXXXXXX PXXXXXXXXXX (or 2XXXXXXX 0XXXXXXXXXX), where 2XXXXXXX indicates the GO Talk Anytime fixed phone line number and PXXXXXXXXXX (or 0XXXXXXXXXX) indicates The Agreement number. The SMS is free of charge.
- The Pay As You GO or Pay Monthly number nominated by Yourself can invite up to three (3) other Pay As You GO and/or Pay Monthly customers to the Community by sending an SMS to 50700281 containing the mobile number being requested to be added to the Community. Each of these SMS is free of charge. As per clause 11 above any changes to these numbers can be made at the cost of €1.16 per number.
- The Pay As You GO and/or Pay Monthly customers eligible to join the Community will become members of the Community only once they accept Your invitation by replying to the SMS sent from GO, and the Community will be considered to be full once three (3) Pay As You GO and/or Pay Monthly customers together with the Pay As You GO or Pay Monthly number nominated by Yourself have joined the Community.
- Once the Community is set up, The Bundle will entitle You to:
- up to four hundred (400) free mobile minutes given in individual bundles of one hundred (100) minutes each in accordance with clause 2 (d) above and which can be used as follows:
- on calls between the four (4) GO mobile numbers within the same Community in accordance with clause 12 above.
- on calls from the four (4) GO mobile numbers towards the GO Talk Anytime fixed phone line number forming part of The Bundle.
- Your free mobile minute bundle, as per clause 2(d) above will be assigned on the day of successful creation of Your Community. Invited Community members will be assigned their respective free mobile minute bundle upon successful registration to Your Community. In the case of Pay As You GO mobile customers each individual bundle will be assigned in full upon joining the Community and will then be renewed each month, on the same date when the first bundle has been assigned. For customers on Pay Monthly plans, their individual free mobile minute bundle will always be assigned on the 1st of every month except for the first bundle which will be assigned on a pro-rata basis on the date when they have successfully joined the Community.
- Any unutilised free minutes are not carried forward if not consumed within the month.
- The free minutes cannot be transferred through Credit Transfer.
- The free minutes are deducted on a per 30-second basis.
- The maximum call duration is 60 minutes and calls shall be automatically terminated when the 60 minutes have elapsed.
- Upon consumption of each individual free mobile minute bundle, intra-community calls to each individual Community member (including calls towards the GO Talk Anytime fixed phone line number) are to be charged at the applicable rates in accordance with the customers’ Tariff Plan. It is Your responsibility to inform the Community members of these conditions.
- The Pay As You GO or Pay Monthly number nominated by Yourself can send a blank SMS to 50700284 at a charge of €0.05 to query the Community members.
- Members of a Community can check whether a number is part of a Community by sending a SMS quoting the number to be checked to 50700284 at a cost of €0.05.
- Members of a Community can check the remaining balance of minutes in their respective free bundle by sending a blank SMS to 50700285 at a charge of €0.05.
- Calls from the GO Talk Anytime fixed phone line towards the registered applicable Community’s GO mobile numbers will be charged as per the Talk Anytime rates.
- The free minutes assigned to each individual Community member, as per clause 2(d), can be used when making calls from Malta in line with clause 13 (a). For the avoidance of doubt any other calls made whilst in Malta to numbers not members in Your Community will be charged at the local call rates applicable to the customer’s mobile tariff plan. The standard charges apply when calling from abroad. For further information regarding roaming charges, please refer to Roaming section of theGO website.
- A Community member is deemed to be part of the Community until:
- The Community member sends a blank SMS to 50700282 (free of charge) at any time to withdraw from the Community. In cases of Pay As You GO type of subscriptions, any Community members withdrawing from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.
- The Pay As You GO or Pay Monthly number nominated by Yourself excludes a member of the Community by sending a SMS to 50700283 (cost is €0.05) containing the mobile number being requested to be withdrawn from the Community. In cases of Pay As You GO type of subscriptions, any Community members removed from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.
- The Agreement is terminated or not renewed, for any reason and by any Party.
- The free minutes entitlement in line with clause 2(d) above will no longer be available if:
- The Agreement is terminated or not renewed, for any reason and by any Party;
- We suspend and/or disconnect any or all of the Services making up The Bundle for any reason attributable to You;
- You or the number nominated by Yourself terminates the Community.
- The Pay As you GO or Pay Monthly number nominated by Yourself is no longer a GO subscriber for mobile services or migrates to any other Tariff Plan not compatible with The Agreement.
- By entering into The Agreement with GO for the provision of The Bundle, You are hereby irrevocably Consent that:
- Your personal data, traffic data and communications data relating to Your use of the Services forming part of The Agreement, including any mobile telephony, will be retained and processed in line with the applicable data protection and retention legislation and that GO may disclose any of this:
(i) among the group companies forming part of the GO group;
(ii) Our sub-contractors or agents;
(iii) between Us and other third parties including other authorised electronic communications providers and operators, Content providers, market research operators, and credit agencies. You acknowledge that such sharing of data is necessary for the purpose of providing better value and services in particular on the electronic communications services or other services as might be provided by Us as well as for fraud prevention, debts and credit referencing and to protect Our legitimate interests and other electronic communications operators and third parties. We commit to preserve all Your rights as data subject at all times;
(iv) if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of The Agreement, respond to claims that any use of the Services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of Us, Our directors, employees, users and the general public.
- Committing to both installing/retaining the (i) GO Talk Anytime fixed phone line service,(ii) GO television service subscription to Gold or above, and (iii) GO internet service subscription up to 4Mbps or above at Residential (non-commercial) Premises owned by Yourself or properly leased in Your name, as indicated in The Agreement within 30 days from date of request of The Bundle.
- Committing to a minimum period of 24 consecutive months (” Term”) from the date of the last of the following services to be installed (i) GO Talk Anytime fixed phone line service (ii) GO television service subscription to Gold or above (iii) GO internet service subscription to 4Mbps or above (“Commencement Date”).
- The Bundle fee of forty-two euro (€42) per month shall come into force from the date when the last of the services specified in clause 2(a), 2(b) and 2(c) above would have been installed at the Registered Premises as indicated in The Agreement. For the avoidance of doubt, any applicable usage charge shall commence from the date of the installation of the particular service.
- Unless The Agreement is earlier terminated, on the expiry of the Initial Term or any subsequent renewed Term, subject that The Bundle would still be commercially marketed at the time, The Agreement will be automatically renewed for further twenty-four (24) month period. Should You not wish to renew The Bundle, You must notify Us in writing at least fifteen (15) days prior to expiry of the Term or any subsequent renewed Term.
- You acknowledge and agree that any free set-top boxes/CAM / modem You may be entitled to under The Bundle Terms and Conditions will only be issued whilst The Bundle is still being offered to the public. For the avoidance of doubt, You acknowledge and agree that any set-top box/ CAM /modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the set-top box/ CAM / modem shall be returned to Us upon termination, for whatever reason, of this Agreement. In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, willful damage, connection to unsuitable supply power, surges, lightening, tampering or service by unauthorised personnel, You will be liable to pay to Us the sum of seventy-five euro (€75) per leased set-top box/CAM and fifty euro (€50) for the modem. Such charge shall become immediately due and is to be paid directly to Us.
- Should The Bundle and/or any of the services as described in clause 2 (a), (b) and (c) be terminated by either You, or Us for any reason attributable to You, prior to the lapse of the Initial Term, the following penalty charges, which for clarity are in addition to any other fees, dues, or charges howsoever defined in terms of The Agreement, shall become immediately applicable:
a. a one-time Bundle Disconnection fee of fifty euro (€50). For the avoidance of doubt this fee will be levied even when downgrading to Home Pack Silver at €33, and;
b. A one-time charge of sixty-four euro and ninety-nine euro cents (€64.99) for the lease of each set-top box/CAM that has been provided to You by Us.
- For the avoidance of doubt, in the event that You terminate The Bundle as per clause 20 above or opt not to renew The Bundle after the expiry of the Term, but choose to retain any of the services offered by Us, You agree that these services shall be charged at the standard rates applicable at the time and are governed by the applicable terms & conditions.
- The Bundle is applicable only in those geographical areas where the television service, fixed phone line service, and internet service can be covered by Us. Should one of the services not be available, We will inform You in writing of the options available and the respective charges that will come into force within thirty (30) days of having been so notified. For the avoidance of doubt, should You be terminating The Bundle to temporarily/permanently move to any other Residential Premises where the television service, fixed phone line service and internet service cannot be reached by Us, the charges as explained in clause 20 will remain applicable.
23. The Bundle is applicable only where Your Residential Premises are reached by full DTTV coverage. At Our discretion, a free booster to improve signal level to Our requirement may be provided at no cost for the duration of The Bundle. Replacements to any damaged booster after date of installation will be provided by Us against the applicable charges as per Schedule of Charges.
- Once all Bundle services as indicated in clause 2 have been activated, The Agreement, of which The Bundle Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or television and/or internet services. Furthermore, a new 24 month Term indicated in clause 16(c) shall commence on the Commencement Date.
- For the avoidance of doubt, in the event that You choose to subscribe to any of the Home Pack add-on services which We may issue from time to time, to the extent applicable the respective Home Pack add-on service shall be governed by the applicable standard terms and conditions of the individual service, without, however, in any way diminishing Your obligations in terms of The Agreement.
- We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.
- All charges related to the service including Equipment charges will be billed according to the billing period depending on your Agreement with Us. Go reserves the right to charge a fee for invoices sent by post should an e-billing service be made available.
- We reserve the right to terminate this Agreement in the event of any deliberate abuse and/or misuse of the services subject matter of this Agreement, or if in default of payment.
- We reserve the right to amend these terms and conditions at any time, provided that We shall give You a thirty (30) days’ written notice prior to such amendments taking effect. Should You not wish to accept the proposed amendments, You must, within thirty (30) days of having been so notified, inform Us of such non-acceptance. For the sake of clarity, such notification of non-acceptance on Your part shall be deemed to constitute a termination of The Agreement in terms of clause of 20 above in which event, the penalty charges therein stipulated shall not become applicable. Failure on Your part to notify Us in writing within the stipulated time period of such non-acceptance will constitute an irrevocable acceptance of any such amendments for the duration of this Agreement.
- This Agreement and all matters relating to it shall be governed, construed and take effect in accordance with the laws of Malta and the parties submit to the exclusive jurisdiction of the courts in Malta.
- This Agreement has been drafted and negotiated in the English language and the English text shall be regarded as the authoritative text. If this Agreement is translated into any other language, any ambiguity or disagreement that may arise shall be resolved by reference to the English text.
Home Pack Gold Interactive
- This Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”). The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as the standard terms and conditions of each individual service making up The Bundle and any other applicable terms and conditions. In the event of any difference or conflict between The Bundle Service Terms and Conditions, the standard terms and conditions of each individual service making up The Bundle, and any other applicable terms and conditions, The Bundle Service Terms and Conditions shall prevail.
- The Bundle entitles You to all of the following services at the rate of forty-seven euro (€47) per month:
- GO Gold interactive television service.
- GO Talk Anytime fixed phone line service and 60 free minutes to other local fixed phone line networks in accordance with clause 7 below.
- Up to 4Mbps GO internet service, subject to the speed your line can attain.
- Up to 400 free mobile minutes on a monthly basis, given in up to four (4) individual free minute bundles of 100 minutes each, with one (1) bundle per individual member within the Home Pack mobile community (‘’Community”) in accordance with clause 9 below.
- The rate of forty-seven euro (€47) per month includes the access fee of one (1) television service as indicated in clause 2(a) above. To activate GO Gold television service on other DTTV set-top boxes/CAMs within the Residential Premises, an additional monthly GO TV Network Access fee per set-top box /CAM as per Schedule of Charges applies.
- If You are a new television customer, The Bundle entitles You to all of the following:
- Free standard installation of the GO interactive television service indicated in clause 2(a) above. For the avoidance of doubt, the free GO television installation will be provided at the Residential Premises indicated in The Agreement.
- One (1) Free GO interactive HD box, in accordance with clause 5 below. For the avoidance of doubt should you require DTTV service on additional tv outlets, the one-time charges for the set top box/es and/or CAM/s including installation per set top box/es and/or CAM/s shall apply as per rates stipulated in the Schedule of Charges. It is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.
- If You are an existing GO television subscriber, and have already benefitted from a set-top box/CAM offer under a previous offer/s, You would be entitled to the free use of a GO interactive HD box upon the return of Your one (1) free DTTV set-top box/CAM when upgrading to The Bundle, and committing to all terms and conditions of The Bundle. For the avoidance of doubt should You have benefited from a set-top box/CAM offer under a previous offer/s in a period less than six (6) months and had benefited from a total of two (2) free set-top box/CAM/s, the lease charge of the set-top box/CAM as per schedule of charges will become applicable when retaining one of the set-top box/CAMs.
- If You are a new fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in clause 2(b) above. For the avoidance of doubt, the free GO fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.
- The Talk Anytime service will entitle You to an additional sixty (60) free minutes to other local fixed phone line networks per month for the duration of The Agreement on the following conditions: a. The 60 free minutes are assigned on the first day of each month and are valid within the same month. b. Any unutilised free talk-time is not carried forward if not consumed within the month. c. b. The free use of a GO standard modem for the internet service indicated in clause 2(c) above. For the avoidance of doubt, it is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.
- For You to benefit from the free bundle of mobile minutes as per clause 2(d) above, You need to activate Your Community as per clause 12 below. You may also invite up to three (3) other GO mobile numbers, in addition to Your GO mobile number to form part of the Community. The standard charges apply when calling from abroad. For further information regarding roaming charges, please refer to Roaming section of the GO website.
- A Community member is deemed to be part of the Community until:
- The Community member sends a blank SMS to 50700282 (free of charge) at any time to withdraw from the Community. In cases of Pay As You GO type of subscriptions, any Community members withdrawing from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.
- The Pay As You GO or Pay Monthly number nominated by Yourself excludes a member of the Community by sending a SMS to 50700283 (cost is €0.05) containing the mobile number being requested to be withdrawn from the Community. In cases of Pay As You GO type of subscriptions, any Community members removed from the Community will have their mobile tariff plan automatically migrated to GO’s Pay As You GO Base Plan.
- The Agreement is terminated or not renewed, for any reason and by any Party.
- The free minutes entitlement in line with clause 2(d) above will no longer be available if:
- The Agreement is terminated or not renewed, for any reason and by any Party;
- We suspend and/or disconnect any or all of the Services making up The Bundle for any reason attributable to You;
- You or the number nominated by Yourself terminates the Community.
- The Pay As you GO or Pay Monthly number nominated by Yourself is no longer a GO subscriber for mobile services or migrates to any other Tariff Plan not compatible with The Agreement.
- By entering into The Agreement with GO for the provision of The Bundle, You are hereby irrevocably Consent that:
- Your personal data, traffic data and communications data relating to Your use of the Services forming part of The Agreement, including any mobile telephony, will be retained and processed in line with the applicable data protection and retention legislation and that GO may disclose any of this:
(i) among the group companies forming part of the GO group;
(ii) Our sub-contractors or agents;
(iii) between Us and other third parties including other authorised electronic communications providers and operators, Content providers, market research operators, and credit agencies. You acknowledge that such sharing of data is necessary for the purpose of providing better value and services in particular on the electronic communications services or other services as might be provided by Us as well as for fraud prevention, debts and credit referencing and to protect Our legitimate interests and other electronic communications operators and third parties. We commit to preserve all Your rights as data subject at all times;
(iv) if required to do so by law or in the good faith belief that any such preservation or disclosure is reasonably necessary to comply with legal process, enforce the terms of The Agreement, respond to claims that any use of the Services violates the rights of third-parties, or otherwise to protect the rights, property or personal safety of Us, Our directors, employees, users and the general public.
- Committing to both installing/retaining the (i) GO Talk Anytime fixed phone line service,(ii) GO television service subscription to Gold interactive or above, and (iii) GO internet service subscription up to 4Mbps or above at Residential (non-commercial) Premises owned by Yourself or properly leased in Your name, as indicated in The Agreement within 30 days from date of request of The Bundle.
- Committing to a minimum period of 24 consecutive months (“Term”) from the date of the last of the following services to be installed (i) GO Talk Anytime fixed phone line service (ii) GO television
subscription to Gold interactive or above (iii) GO internet service subscription to 4Mbps or above (“Commencement Date”).
- The Bundle fee of forty-seven euro (€47) per month shall come into force from the date when the last of the services specified in clause 2(a), 2(b) and 2(c) above would have been installed at the Registered Premises as indicated in The Agreement. For the avoidance of doubt, any applicable usage charge shall commence from the date of the installation of the particular service.
- 1 Unless The Agreement is earlier terminated, on the expiry of the Term or any subsequent renewed Term, subject that The Bundle would still be commercially marketed at the time, The Agreement will be automatically renewed for further twenty-four (24) month period. Should You not wish to renew The Bundle, You must notify Us in writing at least fifteen (15) days prior to expiry of the Term or any subsequent renewed Term.
- You acknowledge and agree that any free set-top boxes/ CAM/ modem You may be entitled to under The Bundle Terms and Conditions will only be issued whilst The Bundle is still being offered to the public. For the avoidance of doubt, You acknowledge and agree that any set-top box/ CAM/modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the set-top box/ CAM/modem shall be returned to Us upon termination of this offer. In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, wilful damage, connection to unsuitable supply power, surges, lightening, tampering or service by unauthorised personnel, You will be liable to pay to Us the relative charges as stipulated in the Schedule of Charges. Such charge shall become immediately due and is to be paid directly to Us.
- Should The Bundle and/or any of the services as described in clause 2 (a), (b) and (c) be terminated by either You, or Us for any reason attributable to You, prior to the lapse of the Initial Term, the following penalty charges, which for clarity are in addition to any other fees, dues, or charges howsoever defined in terms of The Agreement, shall become immediately applicable:
- A one-time Bundle Disconnection fee of fifty euro (€50). For the avoidance of doubt this fee will be levied even when downgrading to any other Home Pack.
- A one-time charge of one hundred twenty euro (€120) for the GO interactive HD box that has been provided to You by Us in terms of this or any other offer.
- For the avoidance of doubt, in the event that You terminate The Bundle as per clause 20 above or opt not to renew The Bundle after the expiry of the Term, but choose to retain any of the services offered by Us, You agree that these services shall be charged at the standard rates applicable at the time and are governed by the applicable terms & conditions.
- The Bundle is applicable only in those geographical areas where the television service, fixed phone line service, and internet service can be covered by Us. Should one of the services not be available, We will inform You in writing of the options available and the respective charges that will come into force within thirty (30) days of having been so notified. For the avoidance of doubt, should You be terminating The Bundle to temporarily/permanently move to any other Residential Premises where the television service, fixed phone line service and internet service cannot be reached by Us, the charges as explained in clause 20 will remain applicable.
23.Once all Bundle services as indicated in clause 2 have been activated, The Agreement, of which The Bundle Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or television and/or internet services.
- For the avoidance of doubt, in the event that You choose to subscribe to any of the Home Pack add-on services which We may issue from time to time, to the extent applicable the respective Home Pack add-on service shall be governed by the applicable standard terms and conditions of the individual service, without, however, in any way diminishing Your obligations in terms of The Agreement.
- We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.
- All charges related to the service including Equipment charges will be billed according to the billing period depending on your Agreement with Us. Go reserves the right to charge a fee for invoices sent by post should an e-billing service be made available.
- We reserve the right to terminate this Agreement in the event of any deliberate abuse and/or misuse of the services subject matter of this Agreement, or if in default of payment.
- We reserve the right to amend these terms and conditions at any time, provided that We shall give You a thirty (30) days’ written notice prior to such amendments taking effect. Should You not wish to accept the proposed amendments, You must, within thirty (30) days of having been so notified, inform Us of such non-acceptance. For the sake of clarity, such notification of non-acceptance on Your part shall be deemed to constitute a termination of The Agreement in terms of clause of 20 above in which event, the penalty charges therein stipulated shall not become applicable. Failure on Your part to notify Us in writing within the stipulated time period of such non-acceptance will constitute an irrevocable acceptance of any such amendments for the duration of this Agreement.
- This Agreement and all matters relating to it shall be governed, construed and take effect in accordance with the laws of Malta and the parties submit to the exclusive jurisdiction of the courts in Malta.
- This Agreement has been drafted and negotiated in the English language and the English text shall be regarded as the authoritative text. If this Agreement is translated into any other language, any ambiguity or disagreement that may arise shall be resolved by reference to the English text.
Home Pack Silver Interactive
- This Bundle Service Agreement (hereinafter referred to as “The Agreement”) is being entered into by GO p.l.c, (C22334), being the operator of the brand ‘GO’, duly authorized to act in representation of its subsidiary and affiliate companies members of the GO Group (hereinafter referred to as “We” / “Us”/ “Our”). The Bundle (as specified in clause 2 below) is subject to the following terms and conditions (“The Bundle Service Terms and Conditions”), The Agreement entered into between Us and the Registered Residential Subscriber (hereinafter referred to as “You” / “Yourself” / “Your”) indicated therein for the provision of The Bundle, as well as the standard terms and conditions of each individual service making up The Bundle and any other applicable terms and conditions. In the event of any difference or conflict between The Bundle Service Terms and Conditions, the standard terms and conditions of each individual service making up The Bundle, and any other applicable terms and conditions, The Bundle Service Terms and Conditions shall prevail.
- The Bundle entitles You to all of the following services at the rate of thirty-nine euro (€39) per month:
- GO Silver interactive television service.
- GO Talk Anytime fixed phone line service.
- Up to 4Mbps GO internet service, subject to the speed your line can attain.
- Up to 400 free mobile minutes on a monthly basis, given in up to four (4) individual free minute bundles of 100 minutes each, with one (1) bundle per individual member within the Home Pack mobile community (‘’Community”) in accordance with clause 8 below.
- The rate of thirty-nine euro (€39) per month includes the access fee of one (1) television service as indicated in clause 2(a) above. To activate GO Silver television service on other DTTV set-top boxes/CAMs within the Residential Premises, an additional monthly GO TV Network Access fee per set-top box /CAM as per Schedule of Charges applies.
- If You are a new television customer, The Bundle entitles You to all of the following:
- Free standard installation of the GO interactive television service indicated in clause 2(a) above. For the avoidance of doubt, the free GO television installation will be provided at the Residential Premises indicated in The Agreement.
- One (1) Free GO interactive HD box, in accordance with clause 5 below. For the avoidance of doubt should you require DTTV service on additional tv outlets, the one-time charges for the set top box/es and/or CAM/s including installation per set top box/es and/or CAM/s shall apply as per rates stipulated in the Schedule of Charges. It is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.
- If You are an existing GO television subscriber, and have already benefitted from a set-top box/CAM offer under a previous offer/s, You would be entitled to the free use of a GO interactive HD box upon the return of Your one (1) free DTTV set-top box/CAM when upgrading to The Bundle, and committing to all terms and conditions of The Bundle. For the avoidance of doubt should You have benefited from a set-top box/CAM offer under a previous offer/s in a period less than six (6) months and had benefited from a total of two (2) free set-top box/CAM/s, the lease charge of the set-top box/CAM as per schedule of charges will become applicable when retaining one of the set-top box/CAMs.
- If You are a new fixed phone line customer, The Bundle entitles You to free installation of the GO fixed phone line service indicated in clause 2(b) above. For the avoidance of doubt, the free GO fixed phone line installation will be provided at the Residential Premises indicated in The Agreement.
- If You are a new GO internet customer, The Bundle entitles You to all of the following:
- Free installation of the GO internet service as indicated in clause 2(c) above. For the avoidance of doubt, the free GO internet installation will be provided at the Residential Premises indicated in The Agreement.
- The free use of a GO standard modem for the internet service indicated in clause 2(c) above. For the avoidance of doubt, it is being agreed that the modem is being leased free of charge, and any equipment will remain property of GO.
- For You to benefit from the free bundle of mobile minutes as per clause 2(d) above, You need to activate Your Community as per clause 11 below. You may also invite up to three (3) other GO mobile numbers, in addition to Your GO mobile number to form part of the Community. The four (4) Community members can be either subscribed to any Pay As You GO mobile tariff plan as per clause 9 below or to any of the GO mobile Pay Monthly Plans compatible with Home Pack. The latter will hereinafter be referred to as “Pay Monthly”. For the avoidance of any doubt, every member of the Community is entitled to a maximum of one hundred (100) free minutes per month and no transfer of minutes from one member to another is allowed.
- If You are a Pay As You GO mobile customer, Your tariff plan will change to the Pay As You GO Home Pack mobile tariff plan once Your request to activate the Community is successful. If any of the other GO mobile numbers You decide to add to Your Community further to clause 8 above, are also Pay As You GO mobile customers, their tariff plan will also change to the Pay As You GO Home Pack mobile tariff plan once they accept to join Your Community.
- A Community is a group of up to four (4) Pay As You GO and/or Pay Monthly GO mobile customers as per clauses 8 and 9 above, who can benefit from free mobile minutes by joining a Community. The GO mobile number nominated by Yourself to activate the Community will be able to invite three (3) other eligible GO mobile customers as indicated in clause 8 above, to form part of the Community. The first three Community members are added free of charge. Any changes thereafter cost €1.16 per number. Without prejudice to Your and/or Our right to suspend and/or terminate this Agreement, for the avoidance of doubt, it is hereby being expressly stated and agreed that only the registered GO mobile number nominated by Yourself to activate the Community will have the right for the day to day management of and for any information associated with the Community. To be eligible to join a Community, the GO mobile numbers:
- Must be verified by GO as registered customers on the appropriate tariff packages;
- Can only form part of one (1) Community at any given time.
- The Community is formed as follows:
- The Pay As You GO or Pay Monthly number nominated by Yourself activates the Community by sending an SMS to 50700280, containing The Agreement number and the GO Talk Anytime fixed phone line number forming part of The Bundle. The format of the SMS should be as follows: 2XXXXXXX PXXXXXXXXXX (or 2XXXXXXX 0XXXXXXXXXX), where 2XXXXXXX indicates the GO Talk Anytime fixed phone line number and PXXXXXXXXXX (or 0XXXXXXXXXX) indicates The Agreement number. The SMS is free of charge.
- The Pay As You GO or Pay Monthly number nominated by Yourself can invite up to three (3) other Pay As You GO and/or Pay Monthly customers to the Community by sending an SMS to 50700281 containing the mobile number being requested to be added to the Community. Each of these SMS is free of charge. As per clause 10 above any changes to these numbers can be made at the cost of €1.16 per number.
- The Pay As You GO and/or Pay Monthly customers eligible to join the Community will become members of the Community only once they accept Your invitation by replying to the SMS sent from GO, and the Community will be considered to be full once three (3) Pay As You GO and/or Pay Monthly customers together with the Pay As You GO or Pay Monthly number nominated by Yourself have joined the Community.
- Once the Community is set up, The Bundle will entitle You to:
- up to four hundred (400) free mobile minutes given in individual bundles of one hundred (100) minutes each in accordance with clause 2 (d) above and which can be used as follows:
- on calls between the four (4) GO mobile numbers within the same Community in accordance with clause 11 above.
- on calls from the four (4) GO mobile numbers towards the GO Talk Anytime fixed phone line number forming part of The Bundle.
- Your free mobile minute bundle, as per clause 2(d) above will be assigned on the day of successful creation of Your Community. Invited Community members will be assigned their respective free mobile minute bundle upon successful registration to Your Community. In the case of Pay As You GO mobile customers each individual bundle will be assigned in full upon joining the Community and will then be renewed each month, on the same date when the first bundle has been assigned. For customers on Pay Monthly plans, their individual free mobile minute bundle will always be assigned on the 1st of every month except for the first bundle which will be assigned on a pro-rata basis on the date when they have successfully joined the Community.
- Any unutilised free minutes are not carried forward if not consumed within the month.
- The free minutes cannot be transferred through Credit Transfer.
- The free -minutes are deducted on a per 30-second basis.
- The maximum call duration is 60 minutes and calls shall be automatically terminated when the 60 minutes have elapsed.
- Upon consumption of each individual free mobile minute bundle, intra-community calls to each individual Community member (including calls towards the GO Talk Anytime fixed phone line number) are to be charged at the applicable rates in accordance with the customers’ Tariff Plan. It is Your responsibility to inform the Community members of these conditions.
- The Pay As You GO or Pay Monthly number nominated by Yourself can send a blank SMS to 50700284 at a charge of €0.05 to query the Community members.
- Members of a Community can check whether a number is part of a Community by sending a SMS quoting the number to be checked to 50700284 at a cost of €0.05.
- Members of a Community can check the remaining balance of minutes in their respective free bundle by sending a blank SMS to 50700285 at a charge of €0.05.
- Calls from the GO Talk Anytime fixed phone line towards the registered applicable Community’s GO mobile numbers will be charged as per the Talk Anytime rates.
- The free minutes assigned to each individual Community member, as per clause 2(d), can be used when making calls from Malta in line with clause 12 (a). For the avoidance of doubt any other calls made whilst in Malta to numbers not members in Your Community will be charged at the local call rates applicable to the customer’s mobile tariff plan.

- You or the number nominated by Yourself terminates the Community.
- The Pay As you GO or Pay Monthly number nominated by Yourself is no longer a GO subscriber for mobile services or migrates to any other Tariff Plan not compatible with The Agreement.
- By entering into The Agreement with GO for the provision of The Bundle, You are hereby irrevocably Consent that:

- Committing to both installing/retaining the (i) GO Talk Anytime fixed phone line service,(ii) GO television service subscription to Silver interactive or above, and (iii) GO internet service subscription up to 4Mbps or above at Residential (non-commercial) Premises owned by Yourself or properly leased in Your name, as indicated in The Agreement within 30 days from date of request of The Bundle.
- Committing to a minimum period of 24 consecutive months (” Term”) from the date of the last of the following services to be installed (i) GO Talk Anytime fixed phone line service (ii) GO television service subscription to Silver interactive or above (iii) GO internet service subscription to 4Mbps or above (“Commencement Date”).
- The Bundle fee of thirty-nine euro (€39) per month shall come into force from the date when the last of the services specified in clause 2(a), 2(b) and 2(c) above would have been installed at the Registered Premises as indicated in The Agreement. For the avoidance of doubt, any applicable usage charge shall commence from the date of the installation of the particular service.
- Unless The Agreement is earlier terminated, on the expiry of the Term or any subsequent renewed Term, subject that The Bundle would still be commercially marketed at the time, The Agreement will be automatically renewed for further twenty-four (24) month period. Should You not wish to renew The Bundle, You must notify Us in writing at least fifteen (15) days prior to expiry of the Term or any subsequent renewed Term.
- You acknowledge and agree that any free set-top boxes/ CAM/ modem You may be entitled to under The Bundle Terms and Conditions will only be issued whilst The Bundle is still being offered to the public. For the avoidance of doubt, You acknowledge and agree that any set-top box/ CAM/modem being offered in terms of The Bundle is being provided to You free of charge, but is and shall at all times remain Our property, and that the set-top box/ CAM/modem shall be returned to Us upon termination of this offer. In default, or should the equipment be returned damaged or faulty resulting from but not limited to misuse, mishandling, wilful damage, connection to unsuitable supply power, surges, lightening, tampering or service by unauthorised personnel, You will be liable to pay to Us the relative charges as stipulated in the Schedule of Charges. Such charge shall become immediately due and is to be paid directly to Us.
- Should The Bundle and/or any of the services as described in clause 2 (a), (b) and (c) be terminated by either You, or Us for any reason attributable to You, prior to the lapse of the Initial Term, the following penalty charges, which for clarity are in addition to any other fees, dues, or charges howsoever defined in terms of The Agreement, shall become immediately applicable:

- The Bundle is applicable only in those geographical areas where the television service, fixed phone line service, and internet service can be covered by Us. Should one of the services not be available, We will inform You in writing of the options available and the respective charges that will come into force within thirty (30) days of having been so notified. For the avoidance of doubt, should You be terminating The Bundle to temporarily/permanently move to any other Residential Premises where the television service, fixed phone line service and internet service cannot be reached by Us, the charges as explained in clause 19 will remain applicable.
- Once all Bundle services as indicated in clause 2 have been activated, The Agreement, of which The Bundle Terms and Conditions constitute an integral part, shall supersede any and all previous agreement/s entered into by and between Us and Yourself in relation to GO fixed phone line and/or television and/or internet services.
- For the avoidance of doubt, in the event that You choose to subscribe to any of the Home Pack add-on services which We may issue from time to time, to the extent applicable the respective Home Pack add-on service shall be governed by the applicable standard terms and conditions of the individual service, without, however, in any way diminishing Your obligations in terms of The Agreement.
- We acknowledge that in the case of You subscribing to The Bundle through telesales You may terminate The Bundle in accordance with the provisions as laid down in the Distance Selling Regulations, without incurring any penalty charges.
- All charges related to the service including Equipment charges will be billed according to the billing period depending on your Agreement with Us. Go reserves the right to charge a fee for invoices sent by post should an e-billing service be made available.
- We reserve the right to terminate this Agreement in the event of any deliberate abuse and/or misuse of the services subject matter of this Agreement, or if in default of payment.
